What To Do When A Website Copies Your Content

A few months ago we discovered that a website was copying all of our content.

Below is the string of emails which passed between my office and the website owner. The most recent email is at the top. Go to the very bottom of this blog post to get to the first email.

The emails speak for themselves.  I think that the threat of DMCA violation notices being sent to the search engines probably had the biggest impact on the ultimate outcome.

I believe that no additional explanation is required.  Read the emails and enjoy.

We did remove several of the articles from our site. Is there a list you can provide me to identify what is left that was copied. Can you tell me what site it is being copied from other than injurytriallawyer.com ?

This is still a HUGE problem.  Not only has your organization failed to remove all of the Davis Law Group copyrighted content from your website, but you have continued to copy new content that we created and posted AFTER I sent you a cease and desist email on October 10, 2016.

You have repeatedly assured me that you would take steps to rectify the situation AND stop future content theft.  At this point I have very little confidence that you intend to honor your promise.

As I stated in a previous communication with you, our website and all of its content is registered with the United States Patent and Trademark Office (USPTO).  Our copyrighted material is protected under 17 United States Code Section 101. In addition, our content is protected under Section 512(c) of the Digital Millennium Copyright Act (DMCA).

Your continued use of our copyrighted material constitutes the willful, intentional infringement of our copyright.

If this situation is not completely and permanently resolved by November 21, 2016 I will move forward with seeking legal remedies including an injunction, equitable relief, court costs and attorney fees.  And I will send DMCA violation notices to: Goolge, Bing, Yahoo, your website hosting company and your ISP.  This will most likely result in your website and perhaps other websites that you own and/or maintain being completely removed from the internet.

The necessary documents are being drafted now.  I strongly suggest you heed my warning and act immediately so no further action is necessary.

We are working on a full review.  However, an initial analysis shows that many articles are still on your site and that some of our newer articles (ones that have been posted since we initially contacted you) are still being copied.  So apparently, whomever on your team has been grabbing our articles and copying them is still doing it.

In addition, your website is automatically pulling content from our site via our RSS feed.  Therefore, any new content we add to our site is immediately copied by yours.  In order to prevent the theft of content in the future, you will need to disable the auto-pull from our RSS feed as well.

Hello,

We discovered that the website located at the domain http://injuredefender.com, which lists this email address as for the site Administrator, is taking our blog content and republishing it on a daily basis. Just because the site places a link at the top of each blog post to the “Original Article Source” does not mean it is OK to simply steal our content and republish it on a different website. Please take down all of the articles that were taken directly from our website and discontinue this practice.
